What Happens To My Maryland License After Drunk Driving?

For most people in Maryland one of their biggest worries after a DUI or DWI charge is how their ability to drive will be impacted. Cars are important to maintaining jobs, getting to and from school and caring for your children.

Who makes the decision?

The only agency in Maryland to control decisions about your license is the Motor Vehicle Administration. They have the power to suspend or revoke your driving privileges based on the specifics of your offense.

What happens to your license?

If you were arrested on suspicion of drunk driving then the officer likely confiscated your license at the time of the arrest. If you do nothing else, the MVA will suspend your driving privileges automatically 46 days following your arrest.

45 days

If you agreed to take a chemical test and the results showed a BAC of .08 but less than 0.15 percent and you do not have any other DUI convictions within the past five years, you will likely have your license suspended for a period of up to 45 days. However, during this time you are eligible to apply for a restricted license, which would allow you to get to and from work, school, alcohol treatment and other important destinations.

90 days

If you took a chemical test and the results showed a BAC of 0.15 or higher, then you can have your license suspended by the MVA for 90 days if it’s your first offense. Second offenses result in longer suspensions, usually 180 days. Drivers that fall into this category will not be eligible for a restricted driver’s license unless they have an ignition interlock device installed on their car.

120 days

For drivers who refuse to take a chemical test, the MVA will likely suspend your license for 120 days, assuming it is your first refusal. If you have refused once before the MVA can suspend your license for a full year. Drivers will also not be eligible for a restriction license unless they have an ignition interlock device installed on their vehicle.
