Maryland is one of only five jurisdictions in the United States that uses this standard. In a nutshell, if you were involved in a Maryland car accident and you fell below the “standard of care” (and were even the slightest bit at fault or negligent), you are completely barred from recovery. The other driver must be 100% negligent, and you must not be at all negligent in order to recover damages. Sound harsh?? It certainly is.
