Is “Going With The Flow” A Valid Defense To A Maryland Traffic Ticket?
When a driver in Maryland gets stopped for speeding it can be especially frustrating when you feel that you were picked out of a herd. After all, if you’re merely keeping up with the pace of traffic, why should one driver be singled out and ticketed? Many drivers understandably wonder whether “going with the flow of traffic” works as a valid defense to a ticket.
Unfortunately, simply saying you were going with the flow will rarely if ever work to get you out of an otherwise valid traffic ticket. The reason is simple; the state’s rules regarding speed limits are fixed, not relative to the speeds of other drivers. If you are found to have exceeded the legal limit for a particular stretch of road, it is not a valid defense to say that other cars were going just as fast.
A good example for why this is true is that if you were arrested for another crime, let’s say drunk driving, you would never be able to argue that you should get off because everyone around you was also drunk. Same thing with speeding; your responsibility isn’t dependent on the actions of those around you.
