Can I Confer With My Attorney Before Taking A Breath Test?

So you’ve been pulled over in Maryland and the officer suspects that you have been drinking and driving. You don’t know what to do. You wish you could call a Maryland DUI attorney and ask for their advice. Can you? Go ahead and do it….

Maryland recognizes a “14th Amendment” due process right to confer with your attorney prior to deciding whether or not to take a chemical test. The officer cannot deny you this right. If the officer denies your request to consult with an experienced Maryland DUI lawyer, you will have an excellent argument at your Maryland MVA hearing as to why the MVA should take no action in your case.
