FAQ: My Maryland DUI case was dropped, can the MVA still suspend my license?

Yes.  Suspension of your Maryland driver’s license is independent of any verdict at a criminal trial.  If your Maryland DUI case was dropped or you were found not guilty, the MVA can still take action.  A license suspension or modification and participation in the ignition interlock program are administrative penalties that the Maryland MVA may impose regardless of the outcome of your case.

Think of the MVA hearing and the court case as separate and unrelated cases.  The Maryland MVA hearing is a civil hearing and the DUI trial is considered a criminal case.
