Expungement of your Maryland criminal record is a great thing, but only if you are eligible. Here are 6 reasons that will not make you eligible for a Maryland expungement.
1. A guilty finding was entered (except for certain nuisance crimes).
2. If you received a probation before judgment, a nolle prosequi, a stet, a pardon, or a conviction of a public nuisance crime, AND you have been convicted of another crime since then (other than a minor traffic violation) or you are a defendant in a pending case.
3. All civil cases (unless you were charged with a civil offense as a substitute for a criminal charge).
4. “Domestic Violence” cases that are civil proceedings not covered under the expungement statute.
5. A probation before judgment or guilty for a DUI or DWI. (Note: Although these can’t be expunged, a PBJ will only show up on your “semi-private” PBJ record, which is only available to you and a judge.)
6. If you were charged with a minor traffic offense only. Only the MVA can expunge these.
